The Gambling Authority Kansspelautoriteit (KSA) is long known for its strict measures to combat illegal gambling. Around two weeks ago the Authority issued an injunction against the gambling company Gammix Limited, which operates several successful online casinos. Which consequences can the company face if it does not stop operations immediately?

Weekly penalty payment of around 1.5 million Euro

The Dutch Gambling Authority KSA is not tolerating and understanding when combating illegal gambling. As the Authority had announced in a statement in the beginning of the month, it has issued an injunction against the company Gammix Limited. This means that the firm was ordered to stop all illegal gambling offers in the Netherlands immediately.

Should Gammix Limited not uphold the request, the KSA is threatening with a penalty payment. According to the press statement this penalty amounts to 1.48 million Euro per week. The total amount of the penalty could add up to 4.5 million Euro. Even a successful company as Gammix would be affected by this penalty.

The Gammix Ltd. is based in Spinola Road in St. Julians in Malta. Gammix holds a valid licence issued by the Malta Gaming Authority (MGA) and operates the online casinos Locowin, Zinkra, Cashi Mashi, Rant, Stake7 and Simsino.

KSA: Gammix Ltd. holds no licence in The Netherlands

The Dutch Kansspelautoriteit is of the opinion that Gammix Ltd. does not hold a valid gambling licence in The Netherlands. According to the Authority, the current EU-Licence of the Malta Gaming Authority (MGA) is not enough. The company’s current offers clearly constitute an infringement of the Dutch Gambling Law. Nonetheless, Gammix Ltd. has the possibility to seek a judicial review of the decision of the KSA. We must wait and see whether Gammix will actually take the dispute to court or whether it will opt to stop operations in The Netherlands. Some months ago we had already reported that online Casinos in The Netherlands are pushing the limits when it comes to player protection measures.

In March of this year, the Gambling Authority had monitored various platforms which are operated by Gammix Ltd. Several infringements were discovered during this audit. Some of the platforms operated by the company are those of the online casinos Nordslot and Rant. Around a year ago we had reported that the KSA has imposed a fine of 500.000 Euro on an MGA-Casino.

Is the Gammix operation not fair?

The Dutch Gambling Authority has complained that it cannot verify whether Gammix Ltd. Is providing fair gambling products and offers. It also could not verify whether steps are being taken to prevent gambling addiction and whether measures are being implemented to protect the player. The argument of KSA is that Dutch players could be harmed by the online offers provided by Gammix.

As from the 1st of October 2021, online gambling in The Netherlands has been legalised and is subject to strict regulations. Since then, the control pressure has increased, and even more online casinos are experiencing problems with the Gambling Authority. In August of last year we had for example reported, that the Netherlands has introduced a foreign ban on gambling.

Conclusion

The Dutch Gambling Authority KSA is taking drastic measures against alleged illegal gambling products. The company Gammix Ltd., which is well known in the industry was now affected by these measures. Should the online casinos of the company Gammix Ltd remain available for Dutch gamblers, the Authority may impose a weekly penalty fine of nearly 1.5 million Euro. We are excited to see whether Gammix will halt its operations in the Netherlands or whether it will fight the decision of the Gambling Authority in court.
